3. Products & Availability

All goods are made-to-order through Printful. Colors, materials, and prints may vary slightly from images. We reserve the right to discontinue or change products without notice.

4. Pricing & Payment

Prices are listed in USD and may change. Payment is processed securely through Shopify Payments or other accepted payment gateways. You agree to provide accurate payment information.

9. Donations & Community Support

A portion of proceeds (currently 10%) supports Save Historic American Beach and related heritage preservation efforts. Donations are made quarterly. Unless explicitly stated otherwise, donations are not tax-deductible for customers.

10. Limitation of Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, consequential, special, or punitive damages arising from product use or interaction with the website. Our total liability for any claim related to a purchase will not exceed the purchase price of the item in question.

11. Indemnification

You agree to indemnify and hold harmless 1935 American Beach LLC, Shopify Inc., and their respective affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising from your misuse of the site, breach of these Terms, or violation of any law or third-party rights.

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law provisions. Any dispute arising under or related to these Terms shall be brought exclusively in the state or federal courts located in Duval County, Florida.
